1. Agreement to Terms

By accessing or using OgaTailor ("the Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part, you may not access the Service.

2. Definitions

• "Service": The OgaTailor mobile application and related services
• "User": Any person using the Service (Customer or Tailor)
• "Customer": User purchasing tailoring services
• "Tailor": Verified service provider offering tailoring services
• "Content": Text, images, data, and other materials on the Service
• "Order": A request for tailoring services placed through the Service

3. Eligibility

Age Requirements

• Users must be 18 years or older
• Minors (13-17) may use with parental/guardian consent
• Users under 13 are prohibited

Account Requirements

• Provide accurate, complete information
• Maintain account security and confidentiality
• One account per person
• Notify us immediately of unauthorized access

4. User Accounts

Registration

• Required information: name, email, phone number
• Optional: measurements, preferences, profile photo
• Verify email and phone number

Account Security

• You are responsible for all activities under your account
• Use strong passwords
• Do not share credentials
• Immediately notify us of security breaches

Account Termination

We may suspend or terminate accounts for:

• Violation of these Terms
• Fraudulent activity
• Abusive behavior
• Extended inactivity (2+ years)

5. Services Provided

For Customers

• Browse tailor profiles and products
• Submit body measurements
• Receive personalized fit recommendations
• Place orders with tailors
• Track order status
• Review and rate tailors
• Secure escrow payment system

For Tailors

• Create business profile
• List products and services
• Receive orders from customers
• Communicate with customers
• Receive payments through platform
• Build reputation through reviews

6. Orders & Fulfillment

Order Process

1. Customer places order with selected tailor
2. Payment held in escrow
3. Tailor confirms and fulfills order
4. Customer receives and confirms delivery
5. Payment released to tailor

Order Modifications

• Changes must be agreed upon by both parties
• Price adjustments require mutual consent
• Cancellations subject to cancellation policy

Delivery

• Delivery timeframes are estimates
• Tailors responsible for meeting agreed timelines
• Delays must be communicated promptly

7. Payments & Fees

Customer Payments

• Payments processed through secure third-party providers (Stripe, Paystack)
• Supported methods: Card, bank transfer, mobile money
• Payment held in escrow until order completion
• No refunds after tailor starts work (unless defective)

Tailor Fees

• Platform Fee: 10% of order value
• Payments released within 24 hours of customer confirmation
• Minimum payout threshold: ₦5,000
• Payment methods: Bank transfer

Currency

• Primary currency: Nigerian Naira (NGN)
• Additional currencies may be supported

8. Measurements & Fit

Measurement Accuracy

• Customers responsible for accurate measurements
• Measurement guides provided in-app
• Professional measurement services available
• We are not liable for fit issues due to incorrect measurements

Fit Recommendations

• AI-generated recommendations are estimates
• Final fit depends on measurement accuracy
• Tailors may request additional measurements

9. Disputes & Resolution

Dispute Process

1. Contact the other party directly
2. If unresolved, file dispute through app within 14 days
3. Provide evidence (photos, messages, receipts)
4. OgaTailor mediates and makes final decision
5. Decision is binding

Escrow Protection

• Payments held in escrow during disputes
• Released based on dispute outcome
• Platform fee may be refunded in customer's favor

Prohibited Actions During Disputes

• No harassment or threats
• No circumventing the platform
• No false claims

10. Reviews & Ratings

Review Guidelines

• Must be based on actual experience
• No profanity or hate speech
• No personal information
• No promotional content
• No quid pro quo reviews

Review Moderation

• We reserve the right to remove reviews violating guidelines
• Suspicious review patterns investigated
• Fake reviews result in account suspension

11. Intellectual Property

Platform Content

• All platform content (design, code, logos, text) owned by OgaTailor
• Users granted limited license to use the Service
• No reproduction without permission

User Content

• Users retain ownership of uploaded content (photos, measurements, reviews)
• Users grant OgaTailor license to use content for Service operation
• We may use aggregated, anonymized data for improvements

Tailor Content

• Tailors retain rights to product designs
• Grant OgaTailor license to display products
• Responsible for ensuring no IP infringement

12. Prohibited Activities

Users may NOT:

• Violate laws or regulations
• Infringe intellectual property rights
• Transmit malware or harmful code
• Harass, abuse, or threaten others
• Impersonate others
• Manipulate reviews or ratings
• Circumvent payment system
• Share login credentials
• Scrape or data mine the platform
• Interfere with Service operation

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND:

• No Guarantee: We don't guarantee uninterrupted, secure, or error-free service
• Third-Party Services: Not responsible for third-party provider actions
• User Interactions: Not responsible for disputes between users
• Product Quality: Tailors solely responsible for product quality
• Fit Accuracy: AI recommendations are estimates, not guarantees

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• No Consequential Damages: Not liable for indirect, incidental, or consequential damages
• Maximum Liability: Limited to amount paid in the 12 months prior to claim
• User Responsibility: Users assume risk for transactions

EXCEPTIONS: Liability cannot be excluded for fraud, death, or personal injury caused by negligence

16. Indemnification

You agree to indemnify and hold OgaTailor harmless from claims arising from:

• Your violation of these Terms
• Your violation of third-party rights
• Your use of the Service
• Your Content

17. Modifications to Terms

We may modify these Terms at any time:

• Notice: 30 days' notice for material changes
• Acceptance: Continued use constitutes acceptance
• Rejection: Discontinue use if you disagree

18. Termination

By Users

• Close account anytime in settings
• Outstanding obligations must be fulfilled
• Data deleted per Privacy Policy

By OgaTailor

We may terminate immediately for:

• Terms violation
• Illegal activity
• Risk to Service or users
• Extended inactivity

Effect of Termination

• Access to Service revoked
• Outstanding payments processed
• User data handled per Privacy Policy
• These Terms survive termination where applicable

19. Governing Law

Jurisdiction

• Governed by laws of Federal Republic of Nigeria
• Disputes subject to Nigerian courts' jurisdiction
• Arbitration preferred before litigation

Dispute Resolution

1. Negotiation: 30 days good-faith negotiation
2. Mediation: If negotiation fails
3. Arbitration: Binding arbitration in Lagos, Nigeria
4. Litigation: Only after exhausting above options

20. Miscellaneous

Entire Agreement

These Terms, Privacy Policy, and referenced documents constitute the entire agreement.

Severability

If any provision is unenforceable, remaining provisions remain in effect.

No Waiver

Failure to enforce any right does not waive that right.

Assignment

You may not assign these Terms. We may assign without restriction.

Force Majeure

Not liable for failures due to circumstances beyond reasonable control.

Third-Party Rights

No third-party beneficiaries unless explicitly stated.

Language

English version controls in case of translation conflicts.
